In response to hazmana sent to him (and co-defendants) by a Lakewood beis din, Rabbi Efrem Goldberg, Rabbi of the Boca Raton Synagogue wrote the following:
We have consulted prominent Dayanim as well as Gedolei Yisroel who have advised us there is no Choshen Mishpat question and nothing for a Beis Din to adjudicate regarding this issue. Nevertheless, we responded with Batei Din we would agree to appear before. As far as we are concerned, we have already gone lifnim meshuras ha’din.
Upon further clarification, Rabbi Goldberg in fact had not responded with Batei Din (plural) in front of whom he would agree to appear, but only offered one alternative, namely the RCA, in violation of the accepted practice to offer three alternatives.
It is also unclear how a gadol (unnamed) can supposedly authorize someone to disobey the shulchan aruch which states that one is required to appear before beis din, without hearing from the other litigant.
